1. 適用

本利用規約(以下「本規約」)は、NIACraftive(以下「当方」)が提供するスマートフォン向けゲームアプリ「Whirlick」(以下「本アプリ」)の利用条件を定めるものです。利用者は、本アプリをダウンロード・利用することにより、本規約に同意したものとみなされます。

2. 禁止事項

本アプリの利用にあたり、利用者は以下の行為を行ってはなりません。

不正な手段(改造・チート行為・アプリの脆弱性の悪用等)によりスコアやランキング結果を操作する行為
プレイヤー名の入力欄に、他者への誹謗中傷、差別的表現、性的な表現、個人情報、なりすまし、その他公序良俗に反する内容を含める行為
本アプリを逆コンパイル・逆アセンブル・リバースエンジニアリングする行為(法令により認められる場合を除く)
本アプリまたはその一部を、当方の許可なく複製・改変・再配布・商用利用する行為
本アプリのサーバーやシステムに過度な負荷をかける行為、その他運営を妨げる行為
法令または公序良俗に違反する行為

3. ランキング機能・ユーザー生成コンテンツの取扱い

本アプリのランキング機能で表示されるプレイヤー名は、利用者自身が入力するものであり、他の利用者に公開されます。当方は、プレイヤー名やスコア等の表示内容が前条の禁止事項に該当する、または不適切と判断した場合、事前の通知なく当該表示内容を削除・変更し、または当該利用者のランキング機能の利用を制限・停止することができるものとします。

不適切なプレイヤー名を発見した場合は、サポートページに記載の連絡先までご報告ください。

4. アプリ内課金について

本アプリは、プレミアムパック等のアプリ内課金コンテンツを提供する場合があります。購入した課金コンテンツは、原則として返金の対象となりません。ただし、Apple社の定める返金ポリシーに基づく返金申請は、Apple社の窓口を通じて行うことができます。機種変更等により購入状態が反映されない場合は、設定画面の「購入の復元」機能をご利用いただくか、サポートページまでお問い合わせください。

5. 知的財産権

本アプリに含まれるプログラム、デザイン、画像、音声、その他一切のコンテンツに関する知的財産権は、当方または正当な権利を有する第三者に帰属します。本規約は、これらの権利の利用者への譲渡または使用許諾を意味するものではありません。

6. 免責事項

当方は、本アプリの内容の正確性、完全性、有用性、特定目的への適合性についていかなる保証も行いません。
当方は、本アプリの利用により利用者に生じた損害(データの消失、機会の損失等を含みますが、これらに限りません)について、当方の故意または重過失による場合を除き、一切の責任を負わないものとします。
本アプリは通信環境やサーバーの状況により、一時的に利用できない場合があります。

7. サービスの変更・中断・終了

当方は、利用者への事前の通知なく、本アプリの内容(ランキング機能等のサーバーを利用する機能を含む)を変更、追加、または提供を中断・終了することができるものとします。これにより利用者に生じた損害について、当方は責任を負わないものとします。

8. 本規約の変更

当方は、必要と判断した場合には、利用者への事前の通知なく本規約を変更することができます。変更後の規約は、本ページに掲載した時点から効力を生じるものとします。

9. 準拠法・管轄

本規約の解釈にあたっては、日本法を準拠法とします。本アプリに関して紛争が生じた場合には、当方の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

1. Application

These Terms of Use ("Terms") set out the conditions for using the mobile game app "Whirlick" (the "App") provided by NIACraftive ("we", "us"). By downloading or using the App, you are deemed to have agreed to these Terms.

2. Prohibited Actions

When using the App, you must not:

Manipulate scores or ranking results through unauthorized means, including modification, cheating, or exploiting vulnerabilities in the App
Enter harassing, discriminatory, sexual, personally identifying, impersonating, or otherwise offensive content in the player name field
Decompile, disassemble, or reverse-engineer the App, except as permitted by law
Reproduce, modify, redistribute, or commercially exploit the App or any part of it without our permission
Place excessive load on the App's servers or systems, or otherwise interfere with its operation
Engage in any activity that violates applicable law or public order and morals

3. Leaderboard and User-Generated Content

Player names displayed on the App's leaderboard are entered by users themselves and are visible to other users. We may, without prior notice, remove or alter any displayed name, score, or other content we determine to violate Section 2 or to otherwise be inappropriate, and may restrict or suspend a user's access to the leaderboard feature.

4. In-App Purchases

The App may offer in-app purchase content, such as a premium pack. Purchased content is generally non-refundable, except where a refund is granted through Apple's own refund process. If your purchase status is not reflected after changing devices, please use "Restore Purchase" in the settings menu, or contact us via the Support page.

5. Intellectual Property

All intellectual property rights in the App's programs, designs, images, audio, and other content belong to us or to third parties who have granted us the right to use them. Nothing in these Terms transfers or licenses these rights to you.

6. Disclaimer

We make no warranty regarding the accuracy, completeness, usefulness, or fitness for a particular purpose of the App's content.
Except in cases of our willful misconduct or gross negligence, we are not liable for any damages (including but not limited to data loss or loss of opportunity) arising from your use of the App.
The App may be temporarily unavailable due to network conditions or server status.

7. Changes, Suspension, or Termination of Service

We may change, add to, suspend, or discontinue any part of the App (including server-dependent features such as the leaderboard) without prior notice. We are not liable for any resulting damages to users.

8. Changes to These Terms

We may revise these Terms at any time without prior notice when we deem it necessary. The revised Terms take effect once posted on this page.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location as the court of first instance.
